Notice to owner is a precautionary measure that must be served before the owner pays the general contractor in full. Ensuring timely service of a Notice to Owner is crucial to protect your right to claim a lien. If you are not directly contracted by the property owner, you must send a Notice to Owner to protect your lien rights and/or bond claim rights. Sending a Notice to Owner effectively notifies the property owner or project manager that you are a subcontractor involved in the project. 
  • Notice must be delivered to the owner and general contractor within 45 days from the commencement of contractED work, or postmarked by the 40th day from the start of contractED work. 
  • All parties listed on the Notice of Commencement must also be NOTIFIED. The NTO will be sent to all parties via certified mail and regular mail. Upon request, we can send your notices by certified return receipt.
